Terms and Conditions

In these terms, "we", "us" and "Omaelix" mean Omaelix Wellness, and "you" means the person using the service. You can reach us at support@omaelix.com.

Omaelix Wellness is operated by NL Masina, trading as Omaelix, a sole trader in South Africa.

If you are using Omaelix on behalf of an organisation, you confirm that you have the authority to accept these terms for that organisation. If you are using it as an individual, you confirm that you are of legal age in your country.

By creating an account, completing the health assessment, or continuing to use Omaelix, you agree to these terms. If you do not agree, please stop using the service.

We may update these terms as the product changes or as the law requires. When we make a material change we will let you know in the app or by email. Continued use after a change means you accept the updated terms.

Omaelix is a personal wellness companion. It takes the information you share about your goals, habits, preferences and circumstances, and turns it into daily guidance: meal suggestions, plans, shopping lists, pantry guidance, eating out recommendations and progress insights.

Omaelix is decision support for everyday wellbeing. It is not a medical device, and it does not diagnose, treat, cure or prevent any condition.

Nothing in Omaelix is medical, clinical, nutritional, psychological or professional advice, and nothing in it replaces a consultation with a qualified healthcare professional. Always speak to your doctor or a registered dietitian before making significant changes to your diet, exercise or medication, and especially if you are pregnant, breastfeeding, managing a chronic condition, recovering from illness, or living with an eating disorder.

If you believe you are experiencing a medical emergency, contact your local emergency services immediately. Do not rely on Omaelix in an emergency.

Decisions you take based on guidance from Omaelix remain your own responsibility. You are expected to apply your own judgement and to verify anything that matters to your health.

You must give accurate information when you register and keep it up to date. Guidance from Omaelix is only as good as the information you provide.

You are responsible for keeping your login details confidential and for everything that happens under your account. Tell us promptly at support@omaelix.com if you believe your account has been accessed without your permission.

You must not use Omaelix to:

• break any law, regulation or third party right
• commit fraud, send spam, or impersonate another person
• infringe anyone's intellectual property or privacy
• interfere with the security or integrity of the service, including probing, scanning, introducing malware, circumventing access controls or rate limits, or scraping content
• reverse engineer, decompile, resell or redistribute any part of the service
• generate content that is unlawful, hateful, harassing, or harmful to others
• share content you do not have the rights to, or content that promotes disordered eating or self harm

We may remove content, restrict features, or refuse to generate a response where we reasonably believe this is necessary to keep the service safe and lawful.

You keep ownership of the information and content you put into Omaelix. You grant us a limited licence to host, store and process it solely to operate the service and provide your guidance.

You are responsible for what you enter, for having the rights to any content you upload, and for how you use the guidance you receive. Generated guidance can be incomplete or wrong, and should be reviewed before you act on it.

If you believe content in Omaelix infringes your rights, contact us at support@omaelix.com with the details and we will investigate. We may remove content and suspend accounts that infringe repeatedly.

We own Omaelix, including the software, models, prompts, design, brand and documentation, and all related intellectual property. We grant you a limited, non exclusive, non transferable right to use the service within the plan you have selected. Nothing in these terms transfers ownership to you.

We work to keep Omaelix reliable, but we do not guarantee that it will be uninterrupted, timely, secure or error free. We may change, suspend or withdraw features, and we may perform maintenance that makes the service temporarily unavailable.

Omaelix offers a free tier and a paid Premium subscription, billed monthly, every six months or annually. Prices are shown before you check out.

Payment, billing, currency, tax, invoicing, renewal and cancellation mechanics are handled by our reseller. They are governed by Paddle's Buyer Terms. Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time and keep Premium access until the end of the period you have paid for.

Refunds are covered by our Refund Policy.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

We may suspend or terminate your access where you materially breach these terms, where payment fails and is not resolved, where we identify a security or fraud risk, or where you repeatedly or seriously breach the acceptable use rules above.

You can close your account at any time from your settings. When your access ends we will give you a reasonable window to export your data before it is deleted or anonymised, as described in our Privacy Notice.

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non infringement. The service is provided as is.

We are not liable for indirect, consequential or special damages, including loss of profit, data or goodwill. Our total aggregate liability to you is limited to the fees you paid us in the twelve months before the claim arose.

Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be limited by law.

You agree to indemnify us against claims, losses and reasonable costs arising from your content, your unlawful use of the service, or your breach of these terms.

These terms are governed by the laws of South Africa, and the courts of South Africa have jurisdiction over any dispute, without affecting any mandatory consumer rights you have where you live.

You may not assign these terms without our consent. We may assign them as part of a merger, acquisition or sale of assets. Neither party is responsible for a failure to perform caused by events beyond its reasonable control.
